1. Acceptance and eligibility

By using this website, creating an account, requesting a quotation, placing an order or making payment, you agree to these Terms and the linked Privacy, Shipping and Return & Refund Policies. You should be legally capable of entering into a contract. If you are acting for a company, gym, institution or other entity, you confirm you are authorized to do so.

GST/tax registration details, where applicable, will be shown on the tax invoice and/or relevant commercial document.

3. Product information, availability and legal declarations

We make reasonable efforts to display accurate model names, specifications, images, warranty information, price, MRP, taxes, country of origin/importer details and other mandatory declarations where applicable. Product colours or minor cosmetic details may vary because of photography, screens or manufacturer revisions, but material features should match the description or agreed quotation.

Availability can change. An “in stock” indication is not a final guarantee until the order is accepted and stock is allocated.

4. Price, taxes and quotations

Prices are in Indian Rupees unless stated otherwise. Applicable GST and compulsory charges should be disclosed as required. Freight, unloading, installation or site-work charges may be extra for some equipment only when disclosed in the product page, checkout, quotation or invoice.

FitPro will not manipulate prices to impose an unjustified price or arbitrarily discriminate between consumers of the same class in violation of applicable consumer law.

Written quotations are valid for the period stated in the quotation. Obvious typographical or system pricing errors may be corrected before dispatch; if an accepted prepaid order cannot be supplied at the displayed price due to a genuine error, the customer will be offered the corrected option or a full refund.

5. Orders and confirmation

Placing an order is an offer to buy. An order is accepted when FitPro confirms acceptance/dispatch or otherwise expressly accepts it. We may request identity, address, GST or payment verification for fraud prevention or invoicing.

Consent to purchase must be based on an explicit affirmative action; we do not rely on pre-ticked purchase consent.

6. Payment

Available payment methods may include UPI, card, net banking, payment gateway, bank transfer, COD where offered, or other approved methods. Payment is subject to authorization by the payment provider.

For commercial or made-to-order projects, milestone payments may apply as stated in the accepted quotation. Any cancellation consequence for committed procurement/custom work must be clearly disclosed before payment or production begins.

7. Delivery, installation and inspection

Delivery and installation are governed by our Shipping Policy. Delivery timelines are estimates unless expressly guaranteed. Customers must provide safe access and suitable site conditions. For heavy equipment, unloading or floor shifting may require prior arrangement.

Customers should inspect goods promptly. Acceptance at delivery does not waive rights relating to hidden defects, warranty or legal non-conformity.

8. Cancellation, return and refund

Cancellation, return and refund requests are governed by our Return & Refund Policy. Nothing in these Terms permits FitPro to refuse remedies that applicable consumer law requires for defective, deficient, spurious, misdescribed or otherwise legally non-conforming goods.

9. Warranty and service

Warranty varies by brand/model and will be as stated on the product page, warranty card, quotation or invoice. Manufacturer warranty may require serial number, proof of purchase and compliance with usage/installation instructions.

Unless expressly included, warranty may not cover normal wear, consumables, cosmetic damage, misuse, unauthorized modification/repair, accidental damage, corrosion, water damage, use beyond rated capacity, or damage caused by abnormal power conditions where lawfully permitted. These exclusions do not override statutory rights.

10. Safe use of fitness equipment

Fitness equipment must be assembled, installed, maintained and used according to the manufacturer’s manual, rated capacity and safety instructions. Children should use equipment only under appropriate adult supervision. Commercial operators are responsible for routine inspection, maintenance and safe operating procedures.

Exercise involves inherent physical risk. Users should choose exercise appropriate to their fitness level and seek qualified medical advice where necessary. Nothing in this clause excludes liability that cannot lawfully be excluded.

11. Accounts, reviews and prohibited use

You are responsible for keeping account credentials secure and for information submitted through your account. You must not use the website for fraud, unlawful activity, malicious code, scraping that harms the service, impersonation or false reviews. FitPro will not post or encourage fake consumer reviews or materially misrepresent product quality/features.

12. Intellectual property

Website design, FitPro branding, original text, graphics, catalogues and other proprietary material are protected by applicable intellectual-property law. Third-party brand names, product images and trademarks belong to their respective owners and may be used for genuine product identification or authorized sales.

13. Electronic communications

You agree to receive transactional communications relating to orders, invoices, delivery, installation, warranty, service and account security by email, SMS, phone or WhatsApp. Promotional communication will be sent only as permitted by applicable law and can be opted out of.

14. Liability and statutory rights

To the maximum extent permitted by law, FitPro is not responsible for indirect or consequential loss caused solely by misuse, unauthorized modification, failure to maintain equipment or circumstances beyond reasonable control. However, nothing in these Terms excludes or restricts liability or consumer remedies that cannot legally be excluded, including applicable product-liability rights.

15. Force majeure

FitPro will not be treated as breaching these Terms for delay or failure caused by events beyond reasonable control, provided reasonable steps are taken to mitigate the effect and communicate material delay where practicable.

16. Governing law and dispute resolution

These Terms are governed by the laws of India. We encourage customers to first contact the grievance mechanism below. Consumers retain the right to approach the National Consumer Helpline, competent Consumer Commission or other statutory forum available under law.

For ordinary civil/commercial disputes not governed by a mandatory consumer forum, courts at Gorakhpur, Uttar Pradesh may have jurisdiction where legally permissible and subject to applicable jurisdiction rules.

17. Changes to these Terms

We may update these Terms for changes in law, business process or website functionality. Changes apply prospectively from the updated effective date unless law requires otherwise. Orders already accepted remain subject to the terms applicable at the time of acceptance, except where a legal change must apply.

18. Indian legal framework considered

These Terms and linked policies are structured with reference to the Consumer Protection Act, 2019; Consumer Protection (E-Commerce) Rules, 2020 and amendments; Legal Metrology Act, 2009 and Packaged Commodities Rules where applicable; Information Technology Act, 2000 and relevant privacy/security rules; and the Digital Personal Data Protection Act, 2023 / Rules, 2025 as applicable and as provisions come into force.
